These Terms of Service ("Terms") govern your use of the services provided by HOSTEX LLC ("Hostex", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, purchasing services, or otherwise using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Services

Hostex provides web hosting, VPS hosting, container hosting, and related services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

2.1 Service Availability

We strive to maintain 99.9% uptime for all services. Service availability is subject to our Service Level Agreement (SLA).

2.2 Service Modifications

We may update or modify our services from time to time to improve functionality, security, or performance. We will provide reasonable notice of significant changes.

3. Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Payment Terms

All fees are quoted in the currency displayed at the time of purchase. Payment is due at the time of purchase for new services and upon renewal for existing services.

4.1 Refund Policy

We offer a 30-day money-back guarantee on shared hosting services. VPS and dedicated server refunds are handled on a case-by-case basis.

4.2 Late Payments

Services may be suspended for non-payment. We will provide at least 7 days notice before suspension.

5. Acceptable Use

You agree to use our services in compliance with our Acceptable Use Policy. Prohibited activities include but are not limited to:

• Illegal activities of any kind
• Distribution of malware or harmful content
• Spam or unsolicited bulk email
• Copyright infringement
• Activities that harm our infrastructure or other users

6. Data and Privacy

Your use of our services is also governed by our Privacy Policy. You retain ownership of your data, and we will handle it in accordance with our privacy practices.

7. Intellectual Property

All content, trademarks, and intellectual property related to our services remain the property of Hostex. You may not use our branding without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Hostex shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

9. Indemnification

You agree to indemnify and hold harmless Hostex and its officers, directors, employees, and agents from any claims arising from your use of our services or violation of these Terms.

10. Termination

Either party may terminate services at any time. We may terminate or suspend services immediately for violations of these Terms or our Acceptable Use Policy.

11. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through our platform.
