We work hard to keep our infrastructure stable, secure, and performing at its best, but we can’t promise that our services will always be uninterrupted, have absolute uptime, or operate without any errors, unless we’ve specifically stated otherwise in our Service Level Agreement (SLA).

2. No Warranties

Hostex LLC steps back from all warranties, whether they’re expressed or implied. This includes, but isn’t limited to, merchantability, fitness for a specific purpose, and non-infringement. We don’t guarantee that our services will meet your needs, run without interruptions, or be free from errors, delays, security issues, or data loss.

3. Customer Responsibility

Content: It’s important to note that customers are fully responsible for the legality, accuracy, and security of any data, files, or content they host on our servers. Hostex LLC doesn’t monitor or verify customer content and isn’t liable for anything uploaded, published, or shared by customers.

Backups: While we do have automated backup solutions in place, we can’t guarantee that backups will always be available or complete. We strongly recommend that customers keep their own independent backups of all critical data.

Configuration and Use: Customers need to ensure that their configurations are secure, including managing passwords, scripts, and applications installed in their hosting environment.

4. Limitation of Liability

To the fullest extent allowed by law, Hostex LLC won’t be held responsible for any direct, indirect, incidental, consequential, or punitive damages. This includes, but isn’t limited to:

• Loss of profits, revenue, or expected savings
• Loss of business opportunities or goodwill
• Loss or corruption of data
• Downtime or unavailability of Services due to network failures, third-party providers, or unforeseen events.

In any situation, our total liability will not exceed the total amount you paid to Hostex LLC in the three (3) months leading up to the claim.
